1. Introduction
These Terms of Service ("Terms") govern your purchase and use of Point of Sale (POS) hardware and software from TENACIOUS GROUP ("we", "our", "us"). By placing an order or using our products/services, you agree to these Terms in full.
2. Definitions
- Hardware — POS devices, accessories, and related equipment supplied by TENACIOUS GROUP.
- Software — POS software, licenses, and digital tools supplied by TENACIOUS GROUP.
- Customer / You — Any individual or business purchasing products or services from TENACIOUS GROUP.
- Delivery Partner — Shiprocket, our official shipping and logistics provider.
3. Eligibility
You must:
- Be at least 18 years of age or have the legal capacity to contract.
- Provide accurate, complete, and up-to-date information during the purchase process.
4. Products & Services
4.1 Hardware
- Product images are for illustrative purposes; actual items may vary due to manufacturing updates.
- Specifications provided are for guidance; customers must ensure compatibility before purchase.
4.2 Software
- Software licenses will be delivered electronically.
- Use of software is subject to an End User License Agreement (EULA).
4.3 Availability
All products are subject to availability. We reserve the right to discontinue or modify products without notice.
5. Pricing & Payment
- Prices are quoted in Rs and include applicable taxes unless otherwise stated.
- Full payment is required at the time of order.
- Payment methods accepted will be confirmed during checkout.
6. Order Acceptance
- We reserve the right to reject or cancel any order if fraudulent, incorrect, or in violation of these Terms.
- Order confirmation does not guarantee acceptance until payment is processed successfully.
7. Shipping & Delivery
- TENACIOUS GROUP uses Shiprocket as its delivery partner for all shipments.
- Orders are shipped within the stated processing time after payment confirmation.
- Delivery time estimates are provided by Shiprocket and may vary depending on destination and courier availability.
- Tracking details will be sent to the customer once the order is dispatched.
- Risk of loss passes to the customer once Shiprocket marks the shipment as delivered.

9. Warranties
- Hardware is covered under the manufacturer's warranty.
- Software is provided "as is" unless otherwise stated in the applicable license.
10. Limitation of Liability
- We are not responsible for shipping delays, damages, or losses caused by Shiprocket or any third-party courier.
- Our liability is limited to the value of the purchased product.
11. Governing Law
These Terms are governed by the laws of Gujarat, India, and disputes will be subject to the exclusive jurisdiction of the courts in Surat, Gujarat.
